 "The constitutional amendment authorizing a home-rule municipality to provide in its charter the procedure to fill a vacancy on its governing body for which the unexpired term is 12 months or less.”

Brief Description:
Currently, if a vacancy occurs in an elected municipal position, a special election must be held to fill the position, leaving it vacant in the meantime. Proposition 7, also known as HJR 87, allows a local government to appoint a person to fill vacancy if it is for a period of 12 months or less. This only applies to home-rule municipalities and must be done within 120 days of the vacancy. This does not apply to general-law municipalities because they do not have charters.
