Family and Medical Leave Act
The Family and Medical Leave Act (FMLA) requires covered employers to provide up to 12 weeks of unpaid, job-protected leave per year to eligible employees for certain family and medical reasons. The 12 weeks can be either continuous or intermittent.
Upon return from FMLA leave, employees must be restored to their original or an equivalent position with equivalent pay and benefits.
Employees are eligible if they have worked for the University or another state agency for at least one year and no less than 1,250 hours over the previous 12 months.
Military Family Leave (MFL)
Eligible employees with a spouse, son, daughter, or parent on active duty or call to active duty status in the National Guard or Reserves in support of a contingency operation may use their 12-week leave entitlement to address certain qualifying exigencies.
Special Leave Entitlement – Caring for Service Member
Eligible employees can take up to 26 weeks of leave to care for a covered service member during a single 12-month period.
Requesting Leave under FMLA
An employee must notify his or her supervisor and Human Resources at least 30 days in advance when the need to take leave is foreseeable by completing and submitting a FMLA Request Form. The form, along with a medical certification form if required, should be submitted to Human Resources, located in UTB at The Woods, 451 E. Alton Gloor, via email at Benefits@utb.edu or faxed to 956-882-6599.
If advance notice is not possible, an employee must comply with normal call-in procedures and provide notice as soon as possible. A written notice is recommended; however, a verbal notice may be provided.
Required Certification Form
An employee must submit a certification form supporting the need for leave.
Completed forms can be faxed to 956-882-6599. Human Resources may request periodic certification.
Approval of FMLA Leave
FMLA leave is approved by Human Resources in coordination with the employee’s supervisor.
